The new rules for hiring workers
A general tightening of the access to hiring agency workers, by removing the opportunity to hire “when the work is of a temporary character”. Certain exceptions apply.
A strengthening of hired workers’ right to permanent employment during the hiring period, by giving hired workers, in agreement with workers’ representatives, the right to permanent employment after three years.
A clarification of the legal difference between agency work and enterprise.
A ban on agency work on construction sites in Oslo, Viken and the former county of Vestfold.
Several of the rules are covered by transitional agreements.
Exceptions to the rules
It is allowed to use agency workers between production companies.
It is allowed to use agency workers in agreement with workers’ representatives.
It is allowed to use agency health workers.
It is allowed to use agency specialist workers.
It is allowed to use agency workers for temporary agriculture work.
It is allowed to use temporary workers to replace a (permanent) employee.
